Citizen TV's SK Macharia Fights Uhuru's Cousin

Royal Media Services owner SK Macharia is in a battle with President Uhuru Kenyatta's cousin over a disputed piece of land.

Mr Macharia has moved to court to stop the National Land Commission (NLC) from making a decision on a 100-acre piece of land near Nairobi’s Karura Forest.

Ngengi Muigai - Kenyatta's Kin - has been fighting Mr Macharia and two other businessmen identified as Mr Kibe and Mr Karanja since 1991 for allegedly denying him his share of the piece of land.

Mr Muigai claims they were all directors of Sceneries Limited, a company that purchased the land in 1988 but his co-directors later kicked him out.

The NLC launched investigations in November into how Sceneries Limited under the ownership of Mr Macharia and Mr Kibe, sold the land to Kenya Reinsurance Corporation at Sh550 Million.

In his petition, Macharia wants the commission's ruling stopped on grounds that the process was started without his knowledge and that Mr Muigai's witness testified in his (Macharia) absence.

The Media mogul says he will be forced to refund Kenya Re the Sh550 Million it paid him for the land, should the NLC rule that the sale was unlawful.

On the other hand, Mr Muigai wants the court to dismiss the petition stating that Macharia was not only aware of the proceedings but even participated in them.

He also argues that the court would be interfering with NLC’s constitutional mandate if it stopped the inquiry into the land deal between Mr Macharia and Kenya Reinsurance.

The investigations by NLC were launched after Muigai filed a petition in court. The body investigates lands acquired fraudulently from the government.
