DCI Officers Summoned For Arresting Moses Kuria

Milimani Senior Principal Magistrate Kenneth Cheruiyot on Thursday, July 28 summoned three senior officers at Kilimani Police Station to appear in court over a contempt of court charge.

Kilimani Directorate of Criminal Investigations Officer (DCIO) Fatuma Hadi, Deputy Sub-County Police Commander Aden Mohamed and Deputy Officer Commanding Station (OCS) Martin Fwambwa were summoned to appear in court after defying a court order in the arrest of Moses Kuria.

The Gatundu South legislator filed contempt of court proceedings against the three senior officers through his lawyer-Goeffrey Omenke.

The officers allegedly failed to release him from police custody even after he paid a cash bail of Ksh50,000.  

In his petition, Kuria also sought to have the officers jailed for contempt of court.

"That an order of committal be made against the three officers to prison for such a period as the court may seem fit for contempt of court," read Kuria's petition. 

Moses Kuria was arrested by DCI officers on January 10, 2020, for allegedly assaulting Kiambu activist Joyce Wanja. 

Wanja had reported the matter at the  Kilimani Police Station on December 9, 2019.

She claimed that the law-maker allegedly assaulted her after an interview with Inooro Tv when she confronted him about statements he made at a music show in Ruiru.

In an attempt to avoid spending the weekend in police custody, Kuria moved to court to have officers release him on bond.

Kuria was acquitted by Milimani Court Chief Magistrate Martha Mutuku on July 22, 2021, after Wanja withdrew charges against him. She also dismissed claims that she had been coerced into withdrawing the charges and stated that she had made amends with him.

The Gatundu South MP had told the court in January that they had agreed on an out-of-court settlement.
