Former Vice President Stephen Kalonzo Musyoka has issued a powerful call to the legal fraternity, urging Kenyan advocates to take an active role in protecting democracy following a landmark High Court ruling on political defections.
Speaking at the Law Society of Kenya’s Lower Eastern Advocates Forum at Sisu Hotel in Machakos County on December 6, 2025, Kalonzo described the judgment as a defining moment for the country since it sent a message that political betrayal was unacceptable and restored public confidence in multiparty democracy.
The ruling involved Justices Ngaah, Chigiti, and Mugambi, in which the Isiolo Governor Abdi Guyo and his Deputy Governor defected from the Jubilee Party to UDA shortly after assuming office in 2023.
In his address, Kalonzo alleged that the court’s decision reaffirmed that the will of the people is sacred and cannot be traded like a commodity.
However, despite the legal win, the opposition leader continued to highlight troubling signs that would impact Kenya’s democracy, including election misconduct and a lack of accountability.
Referring to the November 27 by-elections, he raised concerns about targeted violence, noting reports of at least 15 deaths in Kasipul.
Kalonzo, an advocate of the High Court, argued that the DPP should have a constitutional obligation to order inquiries without delay.
He cautioned that if authorities fail to act, citizens may have no choice but to pursue private prosecutions, a right protected under the Constitution.
“Advocates, your work extends far beyond the courtroom,” the United Opposition leader called out to the legal fraternity.
He continued to challenge lawyers to deepen their commitment to pro bono work, as Kenyans did not lack rights but lacked access to those rights.
Additionally, the Wiper party leader advised lawyers to be consistent and principled in their speech, both in court and on social media, because the internet never forgets.
“I dare say that the future of Kenya’s democracy, integrity, and justice rests in your capable hands,” Kalonzo concluded, “your efforts are shaping not just our legal landscape, but the ethical direction of our nation.”
