The Office of the Director of Public Prosecutions (ODPP) on Sunday promised to intervene after a video of a woman who was allegedly jailed wrongly for 10 years surfaced.
In a video by Royal Media Services, Lydia Achieng' narrated how she has served at Lang'ata Women's Prison on a fabricated offence.
Achieng' narrated how a trip upcountry saw her adopt a young girl whose parents had been deceased.
She returned to Nairobi's satellite town of Rongai where she stayed with her adopted daughter, a class eight pupil.
But unknown to her, a love affair between the young girl and a boy of her age would soon land Achieng' in jail.
Sophie, the mother to the boy opposed the relationship and reportedly took on Achieng' to scatter the apparent love affair.
"She came to the salon with police officers who ordered the hair-dryer switched off. They then took me to the police and on the way, I called my mum.
"When my mum asked why I had been arrested, she was told that I had defiled a minor," Achieng' stated.
On denying the charges in court, the woman indicates that she was remanded for several months.
The plaintiff nevertheless failed to show up on several occasions when the case was mentioned.
"Sophie was given one final chance to show up in court but when she took the witness stand, she amazed the presiding judge by indicating that she had made false allegations and wanted to withdraw the case," she added.
The Judge, however, indicated that owing to the magnitude of the charges, the case could not be withdrawn by an oral request but only through a written request by the Attorney General (AG).
Several trips by Sophie and Achieng's mother to the AG allegedly did not bear any fruits and when the case was presented for hearing, the Judge handed the accused a 10-year jail term.
After serving six months, Achieng' appealed the case but due to lack of legal counsel, she applied for pardoning instead of commuting the sentence which saw the Courts quash her request.
In the video published on Jan 24, 2019, Achieng' indicated that she was serving the last two months of her jail-term with the DPP promising to follow up the matter.
"Despite the fact that convict was charged during the era of Police Prosecutors and before the 2010 Constitution, the DPP has directed that an immediate follow be done," the DPP stated.
