High Court Seeks Help from Village Elders

A High Court in Tharaka Nithi County has now resorted to seeking help from village elders in resolving some of the cases.

Chuka High Court is said to have distributed more than 150 civil cases to be handled by the elders as a way of reducing backlog in its records.

A group of 28 elders have reportedly gone through a week-long paralegal training in a bid to help the Court in solving cases, especially those concerning land and family disputes.

The court has reportedly changed tact in handling the cases before it, arguing that the elders would take less than a week to settle the cases compared to the courts. 

"We are able to handle cases very fast because people fear dying compared to courts where some will cheat and go free," said one of the elders.

The elders subject disputing parties to traditional oath as a way of ensuring that they tell the truth to ensure justice.

According to a report by the Nation, the strategy has been working since most of the decisions by the elders' courts are agreeable to the parties thus helping in decongesting the law courts.
