Transport CS Eng. Michael Kamau to Face Prosecution

Infrastructure and Transport Cabinet Secretary Eng. Michael Kamau has been dealt a blow after the high court rejected an appeal to stop his prosecution.

Justice Mumbi Ngugi has today Tuesday directed that the case against Kamau should proceed.

In his appeal Kamau had submitted that his trial is un-procedural, citing that the Ethics and Anti-Corruption Commission(EACC) that investigated him was not well-constituted following the resignation of its commissioners.

Justice Mumbi overruled the appeal saying the absence of commissioners at EACC is not enough reason to stop Eng.Kamau's prosecution.

The judge has forwarded Kamau's file to Chief Justice Dr. Willy Mutunga to constitute a three-judge bench to determine his fate.

The suspended transport CS is accused alongside six members of a tender committee of failing to follow procurement rules in awarding the tender for the construction of Kamukuywa-Kaptama- Kapsokwony-Sirisia road.

Kamau is alleged to have changed the road's design thus leading to the embezzlement of funds.
