The Mombasa High Court has certified as urgent a petition filed by Nyali MP, Mohamed Ali, better known as Jicho Pevu, challenging the County Government of Mombasa’s Ksh 17 billion waste management project.
Justice Jairus Ngaah issued the ruling on December 3, stating that the matter raises concerns that demand the immediate attention of the court.
As a result, the judge directed that all respondents in the case be served without delay and given seven days to file their responses to the petition.
The court further indicated that it will provide additional directions on the case on December 15, 2025, marking the next significant step in the legal process.
According to Mohamed Ali, the multi-billion-shilling project was approved irregularly, and he says there is no evidence of a tender advertisement or public participation.
In addition, Ali claims the county bypassed the County Assembly entirely, despite laws requiring such large projects to receive assembly approval.
Building on those concerns, the Nyali MP stated that his efforts to obtain procurement records, which have been acknowledged by various offices but remain without a substantive response, violate Article 35 of the Constitution and the Access to Information Act.
Due to this alleged secrecy, Ali believes that the public has been denied the right to know how the Sh17B project was initiated, funded, and approved.
In the petition, Ali asked the court to nullify all irregular tenders linked to the project and to compel the county to release all documents related to the procurement.
Moreover, Ali called on the Ethics and Anti-Corruption Commission (EACC) and the Public Procurement Regulatory Authority (PPRA) to open investigations into the controversial deal.
In a press release on December 4, 2025, the Nyali MP concluded that, "We will walk together on this long road to freedom and justice, and I have no doubt Mombasa will eventually attain good governance and accountability! We are proceeding to serve all the respondents and interested parties."
