ODM Member Moves to Court to Have NASA Agreement Nullified

An Orange Democratic Movement (ODM) member has moved to court seeking to alter a NASA deal regarding the term of office of flag bearer Raila Odinga, if he wins the August General Election.

In the case filed on Monday, Reuben Odhiambo Miya argues the agreement to have Odinga run for a single term bars ODM from nominating a presidential candidate after the August polls.

Miya states that the deal which was signed by Odinga denies any other member of the party the chance to seek a presidential nomination on an ODM ticket in case NASA fails to win the polls.

The petitioner further argues that the agreement is unfair since it allows other partner parties in the Alliance the chance to nominate a candidate but bars ODM, which he says is against the Constitution.

“ODM abdicated its duty to ensure that its members' political rights are not infringed as required under Article 38 of the Constitution,” states his court papers.

He now wants the Registrar of Political Parties to deregister the agreement entered into by NASA Coalition and the deal to be declared in violation of political rights of ODM members.

In the arrangement signed by all NASA principals, Odinga will serve for one term if elected in the August polls and the Orange Party will not have the chance to nominate a candidate in the 2022 polls.

Last week, protests erupted in Kisumu after a section of ODM supporters went to the streets declaring that their party boss be allowed to serve for 10 yrs in he wins the upcoming election.

However, Opposition leaders dismissed the protests accusing the Jubilee Party of planning the fracas.
