Jubilee Asks Chief Justice David Maraga to Remove Justice George Odunga From All Election Cases

The Jubilee Party on Tuesday wrote a letter to Chief Justice (CJ) David Maraga requesting for the removal of High Court Judge George Odunga from all cases involving the August 8 polls.

Jubilee Secretary General Raphael Tuju on Tuesday requested the CJ to remove the judge from all election cases on grounds that he is allied to the Orange Democratic Movement (ODM) and related to Siaya Senator James Orengo.

Mr Tuju argued that the Judge had failed to explain his links with Senator Orengo in several electoral cases he had presided at the High Court.

The JP Secretary General accused Justice Odunga of planning to swing the electoral process to the advantage of the opposition.

President Uhuru Kenyatta's party now wants the matter tabled before the Judicial Service Commission (JSC) for more evidence to be provided on how the Judge is allied to the opposition.

“The issue of Justice Odunga, his decisions, his closeness to (Siaya Senator James) Orengo should be tabled before the JSC, where we shall adduce irrefutable evidence.

"Prior thereto, please replace the judge with another judge or a Bench of judges that is not perceived to be hostage to any political party,” Tuju stated.

The Secretary General has in the recent past questioned Odunga's conduct in relation to court matters filed by the Opposition adding that the judge was related to Orengo through marriage.

Some of the cases Jubilee is claiming that Judge Odunga ruled in favour of their competitors include; allowing the opposition to conduct demonstrations that led to the removal of IEBC Commissioners in 2016.
