Former IEBC Chair Issack Hassan Advises Current Chair Wafula Chebukati on the Lawyers to Hire for NASA Petition

Former IEBC chair Issack Hassan has advised the current boss, Wafula Chebukati on the type of lawyers to hire for the Presidential petition filed by the National Super Alliance (NASA).

Speaking in Cambridge, England, for the first time since he left the Commission, Mr Hassan noted that it was important for IEBC to prepare a team of unbiased defence lawyers after NASA files a petition.

"As a rule, the Electoral Management Body (EMB) and its head should use the same lawyer in defending them. The head of the EMB should closely monitor the work of the lawyer.

"The defence strategy employed by the EMB and the head is important," he stated.

He also noted that the commission should pay specific attention to the unbiasedness of their counsels to minimize any conflict of interest.

"The defence counsel must be aware of the importance of maintaining the impartiality of the EMB and its head."

"Since the lawyer will be speaking for you in court, you must ensure he does not bring his personal bias into your defence," he explained.

Hassan, however, failed to mention any specific lawyers.

In the 2013 Presidential petition, IEBC was represented by lawyers Aurelio Rebelo, Ahmednasir Abdullahi and their teams.

IEBC, NASA and other interested parties are set to be engaged in a heated court battle after the Opposition announced that they would challenge the 2017 presidential results at the Supreme Court.

According to the Opposition, the results were computer generated and thus do not represent the will of the people.

"We have now decided to move to the supreme court and lay in front of the world the making of a computer generated elections.

"We will show how they shamelessly cooked results from non-existent polling stations and fake un-gazetted Presiding and Returning officers. They gave figures from non-existent Forms 34A and 34B.

 "We will NOT accept and move on," NASA affirmed.
