NASA Wants IEBC to Produce All Poll Kits and Server Logs

National Super Alliance (NASA) leader Raila Odinga, in the Presidential election petition filed at the Supreme Court, wants IEBC ordered to hand over the 40,883 electronic voter identification devices used in all polling stations.

The NASA brigade also wants the court to compel IEBC to avail all the logs of servers it used in managing the elections.

In addition, the opposition alliance wants the kits and logs provided to them 48 hours after filing of the case.

The two are part of 14 other pleas that NASA has lined up in their petition challenging the results of President Uhuru Kenyatta.

NASA's main prayer in the petition is that the Supreme Court should declare the elections null and void since all the respondents “jointly and severally committed election irregularities".

City Lawyer James Mwamu, while speaking to the Nation, noted that the request for the provision of all kits and server logs would be difficult to achieve since the case has strict timelines.

Mr Mwamu noted that since the gadgets were spread all over the country, the demand could create a difficulty as the electoral commission would need a lot more time than was available to prepare.

He, however, noted that the Court would likely be careful not to be seen as relying on technicalities and showing favouritism to the IEBC.

“I think the court will bend over backwards just to ensure that it is not accused of showing favouritism to one side.

"I think it will do everything that is in its power to do to ensure that what is practical and what is reasonable is given,” he stated.

The various legal teams are expected to meet in court on Saturday, August 26th, 2017, at the pre-trial conference where the court will direct the commission on the handling of the election materials.
