Why Raila Odinga's Lawyers Played Video of Late IEBC ICT Manager Chris Msando at Supreme Court

Lawyers representing the National Super Alliance (NASA) leaders on Monday played a video of the late IEBC ICT boss Chris Msando at the Supreme Court as part of their evidence in the petition challenging the re-election of President Uhuru Kenyatta.

The recording was meant to demonstrate that Msando's murder was linked to the alleged hacking of the electoral commission’s server storing key electoral systems.

In the video, the late IEBC manager is captured assuring the public that the election systems were secure and that nobody could interfere with them under his watch.

Lawyer Anthony Oluoch submitted that Msando had worked to ensure credibility in the polls and that his death just a few days to the elections raised eyebrows regarding the authenticity of the election system.

He further queried the manner in which Msando was replaced, mentioning that the reinstatement of former Director for ICT James Muhati was suspect since he (Muhati) had been sent home over claims of sabotage and integrity issues.

“Mr Muhati was suspended and Msando took over but he (Muhati) returned under unclear circumstances a few days before the killing.

"Our analysis confirms there were two parallel systems playing out at IEBC,” Lawyer Oluoch stated.

Other Counsels who presented their submissions on behalf of the petitioners - Raila Odinga and Kalonzo Musyoka - noted that the elections were a sham and could not be termed as free and fair. 

Lawyer Otiende Amollo submitted that the petitioner had identified 32 fatal errors which, if considered, will automatically invalidate the August 8 election.

According to the Senior Counsel, close scrutiny of the documents presented to the court and obtained from the commission showed a concerted effort to doctor the documents in order to seal the flaws.
