President Uhuru Kenyatta's Strategy to Win Presidential Petition

President Uhuru Kenyatta on Tuesday, in an oral submission to the Supreme Court, sought to dismantle and trash the presidential election petition filed by his rival, Raila Odinga

Through his lawyers Ahmednasir Abdullahi, Fred Ngatia, and Tom Macharia, President Kenyatta maintained that he won the elections with huge margins and called on the Court to uphold the will of the people.

President Kenyatta used the law, statistics and alleged loopholes in Mr Odinga's evidence in an attempt to convince the Supreme Court that he was fairly elected and that the Judges should dismiss the petition, consequently blow up Mr Odinga's bid for the presidency.

Lawyer Abdullahi, in his arguments, explained that the bench should stick to the 2013 judgment, which validated President Kenyatta as legitimately elected.

He argued that the former Prime Minister's case was not about a political contest but would determine whether the 15 million votes cast will be rendered useless on account of an individual's right to seek power.

He lightened up the court when he termed the petition as "science fiction that would only interest Hollywood directors".

According to Abdullahi, the petitioner has put up a lot of claims without any sufficient evidence.

"For the court to agree with the petitioner, it will decide that the votes cast by Kenyans do not count. Even if you expunge our documents, this petition will still be dismissed, these are allegations without any evidence. Abdullahi stated.

Lawyer Ngatia on his part focused on numbers tabulated by the Jubilee Party to show that the President had a majority win in the entire country.

"The third respondent had garnered majority votes in 39 counties. They gave him more than 25 per cent of votes as required by the law," the senior counsel submitted

According to Ngatia, a tabulation of all the disparities raised by the petitioner would see President Kenyatta lose only 800 votes and his opponent would gain 900 votes.

President Kenyatta's lawyers also cited reports from the international community observers who gave the election a clean bill of health.

On the formula used on Monday by the Opposition leader to justify that the results streaming were cooked, the lawyer explained that it could not apply as there were polling stations which had as low as 10 voters and others one.

He added that if the Y=MX+C formula petitioners claim was used was to be applied, it meant that President Kenyatta ought to have received more than 180,000 votes, but that was not the case.

The President's lawyers are hoping that the bench would consider their submissions and throw away the petition.

The Supreme Court is expected to make a ruling on Friday, 1st September 2017.
