Police have revealed details on why Gatundu South MP Moses Kuria and former Machakos Senator Johnstone Muthama were arrested.
According to their charge sheets, the two were arrested for making utterances that were considered to be "incitement to violence contrary to section 96 (a) of the penal code."
Kuria's charge sheet indicates that on 5th September 2017 at Wangige Market in Kiambu County, he used abusive words to wit: "wembe ni ule ule wa kunyoa Raila tena, ya kutairi na ya kwenja muka huyo ( the razorblade is the same to shave Raila again, to circumcise and to shave his wife pubic hair)."
According to the authorities, these words were abusive and intended to "bring physical injury to a person."
In regards to Muthama, his charge sheet indicated that on the 10th September 2017 at Isinya Town in Kajiado County, without lawful excuse uttered words to wit: "Mimi nataka kumwambia na naalika Uhuru Kenyatta na mheshimiwa William Ruto pale Uhuru Park bila askari na mimi na Orengo tuvae gloves tukutane Uhuru Park tuonyeshe kilicho nyoa kanga manyoa; unatisha Raila kama nani."
This is loosely translated to: (I want to tell and invite Uhuru Kenyatta and William Ruto to Uhuru Park without any police officers. Orengo and I will put on gloves and meet them at Uhuru Park and teach them a lesson. Who are you to threaten Raila).
According to the authorities, these comments meant that "it might have been desirable to engage in a physical fight which was calculated to bring death and physical injury to persons."
The two leaders have since been arraigned at Milimani Law Courts awaiting the decision of the Court regarding the matter.
