Makau Mutua Seeks to Join Petition to Remove Chief Justice David Maraga

Law Professor Makau Mutua and Human Rights activist Maina Kiai have written to the Judicial Service Commission (JSC) asking to be enjoined in a petition filed by Nyeri Town MP Ngunjiri Wambugu seeking the removal of Chief Justice David Maraga from office.

Prof Makau has stated: "We've asked JSC not to allow MP Wambugu to withdraw the petition filed against CJ Maraga. We want to expose his lies."

In a letter to the JSC, lawyer Wakwa Wanyoike has noted: "They (Mutua and Kiai) regard the judiciary, KHRC, and other institutions and organizations named in the petition as deserving protection from Mr Wambugu's (and his sponsors) scorched earth policy against the bulwarks of democracy."

The petition had accused Prof Mutua, Kiai and the organizations they represent as being part of an alleged scheme to institute regime change through judicial radicalism.

Mr Wambugu then announced his decision to withdraw the petition citing the 'current political environment'.

Kiai and Mutua have opposed this move, and have asked the Judicial Service Commission to set a date where their presence will be required.

Prof Mutua serves as the Chairperson of the Board of Advisers of the International Development Law Organization(IDLO) while Kiai is a co-founder of the Kenya Human Rights Commission(KHRC).

Both organizations were mentioned in Ngunjiri Wambugu's petition for their input in the development of the Judiciary's guiding document on the handling of electoral disputes.

The motive behind the petition was, however, questioned due to the fact that all the information cited was in the public domain way before the August 8th election.

The Supreme Court on Wednesday delivered its full ruling on the nullification of the presidential election.
