A new petition was on Thursday filed by two voters seeking to reverse Opposition Leader Raila Odinga's win at the Supreme Court.
Jackson Ndegwa and Edwards Kings argue that the Supreme Court judgment that invalidated President Uhuru Kenyatta's win was erroneous and should be overturned.
Th two voters explained that the repeat poll scheduled for October 26 between President Kenyatta and Mr Odinga is a huge burden to an already battered economy.
They submitted that the Sh14 billion set aside for the rerun could be used in other projects such as education or health to transform Kenya.
The two also say that the judgment is precedent-setting and might influence more election petitions involving senators, governors, and MPs and hence add more burden to the taxpayer.
"Our case raises very serious constitutional issues and legal principles and the move by the registrar to reject the case is a violation of the Constitution in Articles 1, 3-1, 10, 22, 35 and 159," Ndegwa stated.
The two had earlier filed a petition at the Court but the deputy registrar of the Supreme Court Daniel ole Keiwua dismissed their application.
They want a judge of the Supreme Court to hear the application which they have classified as urgent.
A date for the hearing is yet to be set.
Last week the Supreme Court delivered its detailed ruling on why the Presidential election was annulled.
In the majority ruling made by 4 of the judges (Chief Justice David Maraga, Deputy Chief Justice Philomena Mwilu, Justices Smokin Wanjala and Isaac Lenaola) noted that the IEBC failed to conduct the poll in line with the Constitution and Election laws.
The minority; Justices Jackton Ojwang and Njoki Ndung'u dissented arguing that the technicalities experienced during the polls were not enough to warrant a nullification of the entire Presidential election..
