Government Takes Action Against Uhuru's Chief Agent

The Government has taken action against President Uhuru Kenyatta's Chief Agent Davis Chirchir after the National Super Alliance (NASA) called for his prosecution over alleged electoral malpractices. 

In a letter to the Director of Criminal Investigation (DCI) Ndegwa Muhoro, the DPP Mr Keriako Tobiko called for the immediate investigation of Mr Chirchir for possible offences that may have been committed during the August election.

DPP Tobiko gave the DCI 21 days to conduct a thorough investigation and provide findings.

"I write therefore pursuant to provisions of Article 157(4) of the Constitution; Section 5(2)b ODPP Act 2013 and Section 21 of Election offenses Act, 2017 to direct and require you to undertake thorough comprehensive and expeditious investigations into allegations and/or matters leveled against Mr Chirchir.

"Such investigations to be completed and the resultant investigation file(s) be submitted to this office within Twenty-one (21) days for perusal and appropriate direction," the DPP's letter read in part.

Mr Tobiko also provided a team of investigators to help the DCI with the investigations.

The DPP issued the order following NASA's letter dated Septemeber 29th 2017 calling for the prosecution of Mr Chirchir within 72 hours.

The Opposition accused the President's agent of accessing the electoral commission's servers illegally during the August 8 General Elections.

In a petition to Tobiko, the Opposition threatened to institute private prosecution of Chirchir should the DPP fail to act.

Mr Chirchir was appointed Chief Agent for the Jubilee Party in July 2017.
