New Order Issued in Supreme Court Registrar's Investigations Over NASA Petition Ruling

The Ethics and Anti-Corruption Commission (EACC) has summoned Rashid Mohammed, the petitioner who wants the Supreme Court registrar Esther Nyaiyaki probed, for statement recording.

The Jubilee Kakamega point-man was invited by the anti-corruption agency through a letter by head of forensic investigations John Lolkolo.

Mohammed wants Nyaiyaki probed on allegations she presented a doctored IT report on flaws which formed grounds for nullification of President Uhuru Kenyatta's re-election.

In his petition, Mohammed stated that the majority decision was influenced by the report which he argues is the opposite of the verification done on the forms 34A, B and C.

This followed the dissenting judgement by Justice Njoki Ndung'u on the petition filed by NASA flag bearer Raila Odinga.

Majority of the judges held that most of the forms lacked security features and bar codes or were not signed by returning officers.

However, Ndung'u held that she examined and found all the forms 34A, 34B and 34C deposited before the court were in required condition.

"The report by the registrar of the Supreme Court is the opposite of the findings by Justice Ndung'u. The two contradicting views cannot be fatally correct," Mohammed stated.

He declared that the inevitable conclusion in the report by the registrar of the Supreme Court was "doctored" or that someone doctored the forms on which she based her report.

"Given the great public interest in the presidential election, the petition which challenged the same and the judgment, it is critical that urgent investigations be undertaken," the petitioner added.

"Any person found to have committed offences in this sensitive and grave matter, in which the Kenyan people were exercising their sovereign authority, be speedily brought to book."
