Governor Waititu Files New Petition on Presidential Election

Kiambu Governor Ferdinand Waititu on Friday moved to court seeking an order to compel the Independent Electoral and Boundaries Commission (IEBC) to conduct the election on October 26.

In his petition, the former Kabete Member of Parliament (MP) also wants the electoral body directed to use manual system of result transmission in future elections.

This move comes after the National Super Alliance leader Raila Odinga withdrew from the presidential race creating uncertainties on whether the election will proceed as planned.

A day after his withdrawal, the High Court ordered Thirdway Alliance presidential candidate Ekuru Aukot to be included in the October 26 repeat presidential poll.

The Court further indicated that all candidates who participated in the August presidential election qualify to run in the upcoming election.

The electoral commission, on its part, affirmed that all eight candidates would participate in the repeat presidential election indicating that the decision was based on the ruling which ordered Aukot's inclusion.

Nonetheless, Mr Aukot has threatened to file a case if IEBC gazettes names of the other six presidential candidates arguing that the court orders only ordered gis inclusion.

The proposed electoral laws that were passed by Parliament seek to make manual transmission of results mandatory even if the elections transmission is conducted electronically.

The new laws also state that in case there is a discrepancy between the electronically transmitted results and the manually transmitted ones, the manual results shall prevail.

Meanwhile, a voter has filed a case at the Court of Appeal challenging High Court Judge John Mativo's ruling that allowed Mr Aukot to participate in the repeat poll.
