Case to Force Jubilee MP to Pay Maraga Sh10 Million Filed

Activist Okiya Omtatah has asked the Court to force Nyeri Member of Parliament (MP) Ngunjiri Wambugu to pay Chief Justice David Maraga Sh10 Million as compensation for violating his rights.

Speaking to Kenyans.co,ke, Mr Omtatah confirmed that he had made the request adding that the Jubilee MP should be penalized for attacking a Judicial officer while on duty.

He also mentioned that the politician should be declared unfit to hold office arguing that the MP did not conduct himself in the right manner.

Mr Omtatah made this request in a petition filed seeking to bar the Jubilee MP from attacking the Chief Justice, Judges of the Supreme Court or any other judicial officer on decisions made while on duty.

In his petition, Mr Omtatah is also seeking an order to stop the prosecution of any judges of the apex court including the Supreme Court President.

During the mention of the case on Wednesday, High Court Judge Chacha Mvita gave Mr Wambugu 14 days to respond to the matter.

The case, which was filed on September, will now be heard on February 5, 2018.

Following the Supreme Court decision that nullified President Uhuru Kenyatta's re-election, Mr Wambugu filed a petition with the Judicial Service Commission seeking removal of Maraga from office. 

According to Wambugu, the CJ exercised a judicial coup by annulling the presidential election and that he had no substantive evidence to support the ruling.

He also noted that the Chief Justice had undue influence on the other Judges who ruled that the August 8 presidential election was null and void.
