Mzee Daniel Moi's Daughter, Jennifer Kositany, in Court Over Sh300 Million Property

Former President Daniel Arap Moi's daughter, Ms Jennifer Kositany, has sued the Kenya Revenue Authority (KRA) over alleged tax arrears on one of her properties.

KRA claims that Ms Kositany has a backlog of Sh5 Million in taxes on her Sh300 Million property located in Nairobi near the Integrity Centre building.

Through her lawyer George Kithi, the former President's eldest daughter, however, claims that the 4.43-acre land has never had arrears.

"It has come to her attention that the chief registrar of lands registered a charge on June 15, 1998, for a sum of Sh5 Million under the direction of KRA through the office of the Commissioner of Income Tax," Mr Kithi told the courts.

The petitioner further accused KRA and the land registrar of acting with malicious intent to frustrate her insisting that she is the rightful owner of the land.

"Without any opportunity to respond, KRA and chief registrar of land decisions were therefore unilateral, biased and unfair.

"KRA acted in an unprocedural, biased, illegal, unfair way and in a clear violation of the principles of natural justice which must guide all administrative actions," the court papers read in part.

Speaking to journalists, Ms Kositany explained that she acquired the land in 1981 together with her husband. Sole ownership of the land transferred to her in 1994 after her husband passed on.

"Even in the event there was any tax liability due and owing by my husband, the same could not have been realised by charging the property as it was neither the deceased person’s property nor did it form part of his estate," the lawyer added.

Suit papers further indicted the taxman for refusing to act on an earlier request to have the charge expunged.

"The refusal and failure by the KRA to respond to my demand that the charge be cancelled dated January 15 is a violation of the law and the Fair Administrative Actions Act, 2015 which guarantees fair administrative action," the court document read.

Mzee Moi has three daughters, Ms Kositany, Doris Moi and June Moi who have all led a quiet life away from the public.

The former President is also facing a court battle over land where members of the Samburu community have accused him of selling their ancestral land in Laikipia to the Kenya Wildlife Service.
