Embakasi South MP Julius Mawathe's Election Nullified

The Supreme Court has nullified the election of Julius Mawathe as the Member of Parliament for Embakasi South.

Delivering his verdict, Chief Justice David Maraga ruled that the results were unsupported by any evidence.

Mawathe had clinched the seat through a Wiper Party ticket.

The suit had been filed by Orange Democratic Movement's Irshad Sumra. 

Mawathe had filed a petition at the Supreme Court after appellate Judges at the Court of Appeal nullified his August 2017 win.

Mr. Sumra had argued that there was some serious mix-up of votes during counting at various centres in the constituency.

Mr. Mawathe's election had earlier been upheld when High Court Judge Grace Nzioka ruled that the prosecutor failed to provide sufficient evidence slapping him with Kshs3 million in invoice costs.

IEBC declared him the winner after he garnered 33,880 against Mr Sumra’s 33,708 votes.

Earlier, CJ Maraga had upheld the election of both Embu Governor Martin Wambora and his Machakos counterpart Alfred Mutua.

The Supreme Court also upheld the decision to nullify Ugenya MP Chris Karan 's election and ordered IEBC to conduct fresh polls.

Kwale Governor Salim Mvurya survived an ouster after the court declared that he was validly elected.

Marsabit Woman Rep Safia Sheikh Adan was declared validly elected in office too.
