Aukot Fiercely Attacks Judge on Ann Kiguta's Show

Leader of of Thirdway Alliance Party, Dr. Ekuru Aukot , on Sunday, launched stinging remarks on a high court judge who stopped county assemblies from debating the Punguza Mizigo draft Bill.

During the interview with K24's Ann Kiguta, on the Punchline show, Aukot bitterly expressed his displeasure with Justice James Makau who ruled against his bill.

Aukot ranted, " I'm very unhappy with the judgment as well as that particular judge Makau," he began. 

"Justice Makau is being convened and I will say it. He's being used by the opponents of Punguza Mizigo to politically to frustrate the initiative," he stated.

The lawyer further clarified to Ms. Kiguta, that the court had only barred the county assemblies from debating and approving the bill.

Aukot who was hosted to discuss in depth, his Punguza Mizigo initiative in the show, as well as other issues pertaining to the constitution, accused his opponents of playing a part in the Judge's decision.

"The opponents of this are using a rogue judge in the judiciary to bar this process because what he has done effectively, is actually amending the constitution of Kenya, a constitutional timeline via court order," he highlighted.

"I'll tell you why I'm so disappointed by this judge and for me, he shouldn't even be on the bench anymore. This judge listed this matter as a mention, he kept our lawyer there for over 8 hours, before converting the mention to a hearing," an annoyed Aukot complained.

According to Aukot, the case that was filed on December 13, 2018, had not been granted any hearing for the application of conservatory orders.

The judge allegedly ordered the Aukot led team, be served with the same petition on condition that they respond within a day's time, from Friday 4:45 PM.

Aukot complained stating that the constitution gave at least three days to respond to a petition, unlike Makau who gave them a day yet the following day was a weekend. 

"On Monday Makau gives this outrageous order to stop constitutional timeline," he outlined.

Ekuru disclosed that he was on the team of experts that wrote the county's constitution, and outlined that there is no precedent in the country's history where a constitutional timeline was ever altered by an interim order. 

He complained, "Justice Makau Is a compromised judge, he cannot make such an outrageous comment. My lawyers are putting up a case against him that will be presented to the Judicial Service Commission(JSC)."
