National Assembly Speaker Justin Muturi has dismissed a petition by Nyali MP Mohamed Ali to have Ministry of Transport CS James Macharia impeached.
Speaking as Parliament resumed session on Tuesday, June 23, Muturi noted that the motion by the MP lacked evidence.
Muturi issued a Communication to the House, stating the inadmissibility of the notice of motion issued by the Nyali MP.
"The proposed motion by the Honorable Member for Nyali Constituency is inadmissible and failed to comply with the provisions of standing order 64 1A paragraph C.
"The proposed motion failed on one important requirement, standing order 64 1A requires that a proposed motion be accompanied by necessary evidence including annexures or sworn testimonies in respect of the allegations," stated Muturi.
Muturi also added that without the necessary annexures he was unable to confirm whether allegations contained in the notice met the threshold or indeed whether there were any annexures between the allegations and the role of Cabinet Secretary.
A number of MPs had also expressed their desire to withdraw their signatures from the motion according to Muturi but were not permitted due to standing orders.
Ali accused Macharia of overseeing stalled government projects worth Ksh.100 billion and being part of the Afya House scandal that saw taxpayers lose Ksh.5.2 billion in 2016 when he was under the Ministry of Health docket.
The Legislator accused Macharia of failing to explain the loss of Ksh.1.5 billion that was meant for construction of housing projects in Nairobi by Suraya Property Group.
Macharia was also accused of sidelining transport stakeholders in the implementation of the directive to have all cargo from the Port of Mombasa transported through the Standard Gauge Railway, thus causing public suffering.
Among the accusations was lying under oath when Macharia appeared before Parliamentary Committees and assured lawmakers that directives on transport cargo had been suspended contrary to the case.
