How Business Woman Lost Ksh14 Million on Mombasa Ship

A woman identified as Loise Mumbi filed a suit at Mombasa Law Courts seeking to be enjoined in a protracted legal battle involving a ship with 16 seaferers.

In her suit, the business lady claimed that she had supplied goods worth of Ksh14 million to the ship identified as F.V RA Horakhty.

She, therefore, demanded that previous court ruling paving way for the sale of the ship be declared null and void until the matter is heard and determined.

Mumbi also explained that she had been approached by the owners of the vessel to deliver the supplies to the ship and its occupants.

"As the High Court has no jurisdiction, this claim should not have been filed in this court irrespective of the amount, the currency involved and nationality of the claimants.

"The applicant’s (Ms Mumbi) claim is prejudiced by the judgement delivered by a court without jurisdiction. We made the provisions and received part payment but Sh14.3 million was outstanding," the court documents showed.

The new development follows an earlier settlement, in March, between the seafarers and the ship owners in which the latter were set to receive Ksh45 million.

The crew had been living on the vessel after claiming that they were abandoned since March 2021 without their wages.

They filed a suit against their employer demanding pay of Ksh28 million together with interest among other orders.

The crew consisted of three individuals drawn from South Korea, six from Indonesia, and the rest from Vietnam.

The owner of the ship, however, refuted the claims stating that the Kenya Maritime Authority (KMA) and its captain was seeking to review the pay.

The parties, however, quickly reached an agreement to settle all the wages before the case proceeded to full hearing.
