Former Law Society of Kenya CEO Apollo Mboya has moved to court to sue the government for launching the Kenya Government delivery portal during the election period.
Mr Mboya, who argues that the State has violated the Elections Act, is seeking to restrain the government from advertising its achievements in its new delivery portal.
The advocate further indicated that the move President Uhuru Kenyatta to launch the website was a threat to the right to free, fair and regular elections.
He claims that the platform is meant to hoodwink Kenyans to vote for Jubilee.
Section 14 of the Election Offences Act prohibits a candidate, referendum committee or any other person from using public resources for the purpose of campaigning during an election or referendum.
The Act also provides that, "no government shall publish any achievements or advertisements of the respective government, either in the print media, electronic media or by way of banners or hoardings in public places during the election period."
Mboya is now urging the court to declare the government portal advertising the government’s achievements as unconstitutional.
He also wants the court to declare that the use of public resources to launch and maintain a website is irregular and unlawful.
