Nairobi County Assembly Speaker Beatrice Elachi was reinstated by the High Court hours after city MCAs voted to impeach her.
“Pending the hearing and determination of this Notice of Motion, a Conservatory Order do issue prohibiting the respondents, their members or any person acting under their behest and direction, from interfering with the execution of the Petitioner of her duties current as the Nairobi City County Assembly Speaker, or otherwise howsoever debating, deliberating upon, or removing from office the Petitioner as the office of the Speaker, Nairobi City County Assembly,” orders issued by the Employment and Labor Relations Court read in part.
103 MCAs backed the motion against Elachi.
Ward representatives from NASA and Jubilee came together to kick out Elachi with a record attendance witnessed at the session.
They accused Elachi of sabotaging the assembly's operations and abuse of office.
“A majority of members have voted for the impeachment motion therefore Speaker Beatrice Elachi stands impeached.
"Therefore, from today (Thursday), Beatrice Elachi is no longer the speaker of the County Assembly of Nairobi,” Deputy Speaker John Kamangu had declared.
Indicative of the MCAs determination to remove Elachi, a number of the Standing Orders were amended to expedite the impeachment process.
An order that requires a three-day notice of motion to be given followed by an ad-hoc committee to investigate the matters before allowing the debate to proceed, was hastily changed.
Waithaka Ward MCA Anthony Kiragu tabled the impeachment motion leveling several accusations against Elachi including that she had undermined the County Assembly Service Board.
Elachi was further accused of quoting in excess of Sh25 million for the purchase of the Speaker’s residence which valued at Sh100 million and threatening the assembly staff to award the tender to her relative.
