The Milimani High Court has upheld the conviction and sentencing of two individuals charged in connection with the 2013 terrorist attack at Westgate Mall.
According to the Office of the Directorate of Public Prosecution (ODPP), the Westgate attack resulted in 67 deaths and over 200 injuries during the mass shooting.
The two convicts had been sentenced to 15 and 18 years in prison for conspiracy to commit a terrorist act and possession of an article connected with terrorism.
During the trial, 46 prosecution witnesses testified before the court.
In her ruling on Friday, Justice Grace Nzioka affirmed that the prosecution's evidence met the threshold required to support the charge of conspiracy to commit a terrorist act.
She stated that the court was convinced of the culpability of the two convicts based on the acts committed.
"The High Court in Milimani upheld the conviction and sentence imposed on two (2) convicts who were charged in connection with the terrorist attack that occurred on the 21st September 2013 at the Westgate Mall in Westlands," read part of the statement from ODPP.
"Sixty-seven (67) people were killed and over two hundred (200) civilians were injured," ODPP further detailed.
The court, however, acquitted the two individuals of the charge of giving support to a terrorist group.
It was found that the evidence presented before the court was insufficient to prove that the duo had supported the terrorist group.
