Isiolo governor Abdi Guyo will remain in office after the High Court in Meru on Friday ruled that his impeachment was null and void.
In his judgment, Justice Heston Mbogo said that the conservatory orders previously issued on June 25 were still in force, blocking any attempts to impeach the governor.
Members of the Isiolo County Assembly had on Thursday, June 26 voted, with 16 out of 18 MCAs supporting the motion to oust him on the grounds of misconduct.
Following the vote, the County Assembly impeached the governor and proceeded to inform the Senate of the governor's impeachment.
However, the ruling by Justice Mbogo has reinstated him as the county boss, terming the impeachment unconstitutional and hence null and void.
On June 25, the High Court in Meru issued conservatory orders temporarily barring the Isiolo County Assembly from proceeding with the impeachment motion against Guyo.
The ruling had categorically restrained the County Assembly, its Speaker, and its Clerk from admitting, debating, or acting on the impeachment motion dated June 10, 2025, until the matter was fully heard and determined.
Despite the conservatory orders, the Assembly went ahead and voted to impeach Governor Guyo on June 26, prompting the court to reaffirm that the orders remained in force and had not been set aside.
"The orders dated June 25, are still in force. Any acts by the respondents or any other party, in defiance of the court order, shall be null and void. The orders shall remain in force until they are set aside by the court," Justice Mbogo directed.
Additionally, Justice Mbogo ordered the Speaker and the clerk to appear in court in person, on Monday next week, to respond to the allegations of contempt of court.
"Having been cited for contempt of court, the first respondent and the contemnor are hereby ordered to appear in person and be accompanied by a counsel of your choice to respond to the alleged contempt of the orders sought on Monday, June 30 at 9 am," the justice ruled.
Mbogo also allowed the respondent lawyers to file an application for recusal and stay of proceedings, but only after appearing in court on Monday and answering the question of whether the order was obeyed.
