Court of Appeal Clears Wavinya Ndeti to Vie for Machakos Gubernatorial Contest

The Court of Appeal has cleared Wiper Party's Machakos gubernatorial candidate Wavinya Ndeti to contest in the August election.

A three-judge bench comprising of Judges Erastus Githinji, Hannah Okwengu and Jamilla Mohamed has upheld a decision by the High Court to allow Wavinya contest for the Machakos governorship seat.

The Court made the ruling following an appeal by a Machakos Member of County Assembly (MCA) challenging the decision to clear her.

Wamunyu MCA Kyalo Kyuli had filed the appeal against High Court Judge, George Odunga's ruling that Ms Ndeti was eligible to vie for the Machakos seat.

In his submission, the MCA argued that documents from the Registrar of Political Parties indicated Ms Ndeti joined Wiper on April 6 despite the decamping deadline being April 5.

Judge Odunga, however, ruled that the Political Parties Disputes Tribunal had already decided that she was a member of Wiper stating that the IEBC committee had no power to nullify the Parties Tribunal's decision.

Wavinya is seeking to be the next Machakos County Governor and will face off with incumbent Governor Alfred Mutua of the Maendeleo Chap Chap party.
