IEBC CEO Ezra Chiloba Explains Why IEBC Published Exercise Book Instead of Form 34A on Portal

IEBC CEO Ezra Chiloba has explained why the commission published results on an exercise book instead of Form 34A for a polling station in Mandera County.

Speaking on Sunday at the Bomas of Kenya, Chiloba clarified that they followed up on the issue of the exercise book and the presiding officer had written to the commission to explain what happened.

“After the tallying, the presiding officer wrote the results on the exercise book and went ahead to test the system only to realize he couldn’t test. Once you lock in the results it cannot be reversed.

“He has however presented the original forms and we uploaded the correct forms,” Chiloba explained.

The IEBC CEO confirmed that the commission was ready to conduct a run-off in case the Supreme court ruled in favour of the National Super Alliance (NASA).

“When we get there, of course, we should be able to do what the laws require us to do because there’s a framework that governs that,” he conveyed.

At the same time, Chiloba commented on the incident in Embakasi South Constituency where IEBC officials tampered with 16 presidential ballot boxes without a court order, stating that there was an oversight by the officials.

"The returning officer of Embakasi South had been hospitalized so he sent the deputy returning officer to retrieve the documents.

"When the officials went to get the documents there was overlap in how they should have gotten them. So we asked the police to hold on to them and requested the party agents to be present,” Chiloba stated.

He further revealed that the IEBC's legal team during the NASA petition would comprise of 4 senior counsels. He, however, declined to reveal the names of the lawyers set to represent the commission.
