The National Super Alliance (NASA) has defied a warning by the Supreme Court cautioning all parties involved in the Presidential petition against commenting on the case outside Court.
In a statement on Wednesday evening, NASA Advisor Salim Lone commented on their evidence filed at the Supreme Court (Form 34As) contrary to the court's warning.
According to Mr Lone, NASA had gathered concrete evidence that the Supreme could not afford to easily dismiss.
"With the concrete evidence NASA has gathered for the Supreme Court, the Court will be unable to avoid confronting the simple, physical reality that over 14,000 Form 34As in NASA's possession have profound anomalies.
"That's about 40 percent of all forms! Even if the Court feels that this massive irregularity was not outright rigging, these forms are so fundamentally flawed that they are lawfully inadmissible, and cannot possibly be accepted as evidence of Uhuru’s victory.
"The only way to avoid discarding these thousands of Form 34s in NASA's possession from the Court's consideration would be to contend, and prove, that NASA forged these forms," Lone stated.
The Supreme Court had earlier on cautioned that all parties in the presidential petition and their supporters should stop instructing judges on how to handle the case outside the court.
The Court noted that under the sub-judice rule, a matter under judicial consideration should not at the same time be tested in the court of public opinion.
The 7-judge bench urged all legal counsels in the case to advise their clients of the penalties that are attached to the contravention of the sub-judice rule.
It noted that it had now fully seized of the petition and such statements may undermine the authority of the court.
The Court also cautioned the public against profiling judges to determine the position they were likely to take.
