Independent presidential candidate Michael Wainaina has applied to be enjoined in the petition filed at the Supreme Court by Opposition Leader Raila Odinga challenging President Uhuru Kenyatta's re-election.
Prof Wainaina in an application to the Supreme Court noted that he would be unfairly discriminated if locked out of the petition.
In the application filed by lawyer Harrison Kinyanjui, Prof. Wainanina says he is not affiliated with any political party.
Reports, however, indicate that the Independent candidate intends to oppose the NASA petition arguing that IEBC conducted a free and fair poll.
He becomes the second person seeking to be enjoined in the case after Thirdway Alliance Presidential aspirant Ekuru Aukot also applied to be enjoined in the case.
In his application, Dr Aukot argues that he has crucial information concerning the recently concluded General Election and which might assist the court to arrive at a just decision.
The Thirdway Alliance leader further noted that an audit by his team showed that some election forms were signed by strangers who were not authorised.
“Our preview of thousands of forms 34As demonstrates that the results announced by the IEBC are based on forged form 34As,” he stated.
The Supreme Court is set to hear Aukot and Wainaina's applications and issue a verdict on Friday, a day before the Pre-trial conference begins on Saturday.
