Nandi Hills Member of Parliament (MP) Alfred Keter's election is at stake after a voter filed a petition in the court accusing him of violating several election laws during the campaign period.
A voter, Robert Kibet Kimei, moved to court to challenge the election of Mr Keter, who was re-elected on a Jubilee Party ticket.
Mr Kimei, the chairman of Citizen Voice Action, filed the petition at the Eldoret High Court alongside his lawyer Joshua Kemboi.
In the petition, the politician is accused of voter bribery, intimidating voters and campaigning on August 6 and August 8th, which was beyond the set period.
"He also failed to honour his campaign calendar of meetings as stipulated by the IEBC," part of the affidavit read.
Mr Kimei further pointed out that there was violence during the campaign period and even on the election day.
The Independent Electoral and Boundaries Commission (IEBC) has also been named in the case as the second respondent.
The electoral body has been accused of failing to conduct proper elections in Nandi Hills according to the law.
"There were bias and partisanship in the holding of elections in Nandi Hills, and IEBC condoned election offences carried out by Keter," Mr Kimei noted.
The petitioner, however, indicated that the incidents of violence and violation of the election laws were reported to the IEBC officials and police but the bodies did not act accordingly.
"The transgressions tainted the election process in Nandi Hills to the extent that the genuine and accurate voice of the people was not expressed," he noted.
Keter was declared the winner of the parliamentary race with 28,923 votes against Benard Kibor, an independent candidate, who garnered 13,872 votes.
Isaac Leting of the Orange Democratic Movement (ODM) came third with 863 votes.
Mr Kibor and Mr Leting were also present in the court supporting the petition filed against Mr Keter and IEBC.
