Raila's Lawyer Makes Outrageous Demand After Final Supreme Court Ruling on Presidential Petition

Opposition leader Raila Odinga's lawyer, James Orengo, on Wednesday night, demanded that the IEBC Headquarters be preserved as a crime scene.

Senator Orengo noted that since the Supreme Court had determined that there were illegalities in the manner in which the elections were conducted, the IEBC offices and all the material therein should be preserved for the purposes of carrying out an investigation.

"In our view, therefore, the IEBC headquarters is for all intents and purposes a crime scene that should be preserved for purposes of carrying out an investigation," Orengo stated.

Senator Orengo called on the office of the Director of Public Prosecutions (DPP) to commence investigations, noting that before the Supreme Court unveiled the full verdict, the DPP had promised that he was going to fully investigate the matter and bring the culprits to book.

He explained that NASA was ready to work with the authorities to ensure that no official who messed up the August election remains in office.

"We are prepared to give assistance to the DPP to ensure that IEBC as currently constituted does not include those who have participated in this unfortunate violation of the law," he noted.

The Senior Counsel explained that the country may be facing a constitutional crisis in the sense that the powers that the President would normally enjoy were extinguished on August 8th, 2017 adding that after the General election the President was acting under temporary incumbency.

"The danger that we now find ourselves in is that if elections are not held within 60 days then he (President Uhuru Kenyatta) will not have the constitutional authority or legitimacy to be in that office," Orengo stated.

Orengo submitted that the law required that an acting President be appointed until a fresh election is held.

Mr Odinga on his part thanked the Judiciary for making the bold decision to nullify the results and announced that NASA would not participate in the fresh elections until the mistakes pointed out are rectified.
