National Super Alliance (NASA) leader Kalonzo Musyoka has on Sunday declared that they would only allow the ballots to be recounted under one condition.
While addressing a rally in Westlands, the Wiper Leader stated that electoral laws needed tightening before any action was taken.
"Hautogopi kura zihesabiwe lakini kwanza wafungue hizo servers which loosely translates to: We are not afraid to have the votes recounted but they have to be open the IEBC servers first," he disclosed.
Kalonzo added that even if the votes were recounted, the decision by the Supreme Court Judges to nullify President Uhuru Kenyatta's win was final.
"Uamuzi wa mahakama ni mwisho kwa hivyo waache kulia lia kama watoto wangojee tuwanyoroshe (The decison by the Supreme Court is final and so they should stop complaining like babies and wait for us to defeat them in the fresh elections)" he stated.
Kalonzo's remarks came even as Jubilee Party Vice Chairman revealed that President Kenyatta through his lawyers is scheduled to file a judicial review of the Supreme Court decision to annul his election.
Mr David Murathe noted that the petition for judicial review will officially be filed next week with a view of having ballot boxes opened and votes counted.
"Because the Supreme Court said the problem was in transmission, we would like the will of the people as expressed in the August 8th election to be validated and there will be no need for a repeat election.
"“For us, the judicial review is extremely necessary because some facts have since emerged and as we speak, the Supreme Court registry is now a crime scene because the Ethics and Anti-Corruption Commission has moved in to carry out an investigation. In the meantime, the President remains in office until another one is sworn-in,” Murathe told the Standard.
Sources privy to the petition explained that the decision had been approved at the highest level and lawyers were making final touches to the application.
