The Judiciary has collected approximately Sh99 Million from the election petitions filed challenging the election of Governors, Senators, Members of Parliament (MPs) and Member of County Assembly (MCAs) who won in the August elections.
About Sh6.7 Million was directed to the judiciary’s bank account as costs of filing the petitions while Sh92.4 million was deposited as security for costs that will be incurred upon determination of the disputes.
According to guidelines gazetted by Chief Justice David Maraga, the Judiciary was charging Sh30,000 for each petition filed to challenge the election of a governor, senator, MP and County Woman Representatives and Sh15,000 for disputes on MCA elections.
The election petitioners were also required to deposit a refundable security of Sh500,000 for the governor, senator, MP and Woman Representative cases.
Applicants for the MCA positions were required to deposit a security fee of Sh100,000.
In the Gazette notice, 34 petitions were filed against governors, 15 against senators, 12 for Woman Representatives, 98 for members of National Assembly and 129 for Members of the County Assembly (MCAs).
Petitions against all the elective posts excluding MCAs will be heard and determined by the High Court Judge designated by the Chief Justice.
The Resident Magistrate Courts will hear and determine petitions against MCAs.
