Pokot South MP Files Petition to Declare NASA's Announcement Illegal

Pokot South Member of Parliament David Pkosing on Monday filed a case challenging NASA leaders Raila Odinga and Kalonzo Musyoka's declaration that there will be no election on October 26th if their demands on electoral reforms are not met.

Speaking to Kenyans.co.ke after filing the petition, Pkosing stated: "We want to declare such an action an illegality. Kenyans are not fools, you cannot break the law and expect to benefit from it."

The lawmaker went on to outline what he believes is NASA's plan for the upcoming election.

Pkosing claimed that NASA has an elaborate plan to intimidate voters and ensure no elections are carried out in a number of their strongholds.

According to the MP, the Opposition was also planning to challenge the validity of the entire election.

He noted that the ongoing nationwide protests by NASA supporters demanding changes at the Independent Electoral and Boundaries Commission (IEBC) was part of the coalition's plan to precipitate a constitutional crisis after October 26th.

He added that he would be issued with a date for the hearing of the case on Tuesday.

Article 138(2) of the Constitution states that an election shall be held in every constituency and for one to be declared President, he/she has to garner over 50% of the vote and at least 25% of the vote in a minimum of 24 of the 47 counties.

NASA, among other things, have demanded the resignation of IEBC CEO Ezra Chiloba and the blacklisting of two companies they accuse of bungling the August polls; Paris-based IDEMIA (formerly OT-Morpho) and Dubai-based Al Ghurair Printing.

Jubilee is also pushing various changes to Kenya's electoral laws that could see, among other things, the IEBC Chairperson disempowered by opening avenues for other commissioners to make key decisions and a manual results transmission system whose results are considered final put in place.
