Orengo Reveals Why Maraga's Team Skipped Supreme Court Case

Siaya Senator James Orengo on Wednesday expressed his disappointment after the Supreme Court failed to hear a case on the postponement of the Presidential election due to lack of quorum.

Speaking after Chief Justice David Maraga adjourned the hearing, Orengo stated that the 'constitution was being overturned' and it was a matter that needed to be looked at closely.

"To our surprise, the CJ could not mobilise a quorum and this is not by coincidence or accident.

"The gazettement of a public holiday on 25 October was part of the design to make sure the court proceedings do not to take place," stated Orengo.

He further highlighted the events that preceded the case stating that everything went south after CJ Maraga announced the case would go on as planned. 

"When Maraga stated the case would go on as planned, there was an attempt on the life Deputy Chief Justice Philomena Mwilu where her driver was shot.

"As you can see, she is not here because of the trauma," added the Senator.

He also stated that the two dissenting judges of the September 1 ruling ( Justice Njoki Ndung'u and Jackton Ojwang) were conspicuously absent and referred to their absence as 'an attempt to undermine the electoral commission and the supreme court.'

Orengo stated that it was not the end of the road for the National Super Alliance (NASA) and condemned acts of intimidation against former Kakamega Senator Bonny Khalwale and Kilifi Governor Amason Kingi.

"This is a sad day for Kenya. Tomorrow's election will be an illegality because the returning officers are incompetent," remarked the lawyer.
