Court Delivers Final Ruling on Jubilee MP's Election

The High Court on Thursday dismissed a petition filed against the election of Mumias East Member of Parliament Benjamin Washiali.

The Court stated that the affidavits for the case were commissioned by "quacks" thus the case did not hold any water.

After his win in the August 8 elections, Washiali challenged those who wanted to contest the election results in court to rethink their plans.

“Those discontented with the election result should stop threatening winners but file cases in courts.

"Better still, I would prefer if they came and joined us in developing our constituency,” he stated.

Washiali acknowledged that some of his opponents had good agenda which he was willing to implement.

He urged his opponents to focus on the future because “the time for politicking is over and it is now time to foster development in Mumias and the country at large”.

Washiali, the Jubilee Party point man in Kakamega county, retained his seat after garnering 13,848 votes against his closest rival, David Wamatsi of  Musalia Mudavadi led - Amani National Congress (ANC), who got 9,315 votes.

There was controversy during the final tallying after results from one of the 91 polling stations were not included.

Results from Muganga polling station were accidentally locked in one of the already counted and sealed ballot box and transferred to the constituency tallying centre.

Independent Electoral and Boundaries Commission (IEBC) returning officer Lazarus Emanikor cancelled the results as the aspirants’ agents failed to agree on whether to open the box to get the results.
