Jubilee MP Files Supreme Court Petition

Pokot South MP David Pkosing has filed a pre-emptive petition at the Supreme Court seeking a declaration that upholds President Uhuru Kenyatta's win in the October 26 election.

This is after the election failed to take place entirely in 25 constituencies and a ruling was delivered by Judge Odunga prior to the poll that decided all Returning and Presiding Officers were in office illegally.

The ruling by Judge Odunga was, however, stayed by the Court of Appeal.

As Mr Pkosing's petition does not challenge the validity of the election results, it will run alongside any other petitions challenging President Uhuru Kenyatta's win.

Legitimacy concerns have been raised based on the issues and a case is expected to be filed at the Supreme Court seeking to annul the results of the election.

Pkosing argues that NASA leader Raila Odinga and his running mate Kalonzo Musyoka orchestrated the election boycott and made it impossible for electoral officials to do their job in Siaya, Kisumu, Homa Bay and Migori.

He stated: “Their wilful decision to subvert and ensure that fresh elections were not held in some constituencies amounted to treason and they should be punished for the offence. They were obliged to obey the Supreme Court, which ordered the fresh election.”

The seven-day deadline to file petitions with the Supreme Court expires on Sunday.

Civil society groups are reported to be putting together a petition of their own challenging the re-election of President Kenyatta.

The Supreme Court nullified President Kenyatta's win in the August 8th poll and ordered for a fresh election to be conducted within 60  days.

At the time, Chief Justice David Maraga stated that he would not hesitate to annul the next election as well if it was not conducted in accordance with the law.
