New Development in Wavinya Ndeti's Petition

The High Court has announced the date for next hearing of the election petition filed by former MP Wavinya Ndeti challenging Machakos Governor Alfred Mutua's win.

High Court Judge Aggrey Muchuele on Thursday indicated that the election petition seeking to overturn Governor Mutua's re-election would resume on November 10.

During the submissions, Wavinya Ndeti's lawyer Otiendo Amollo and Mutua's lawyer Waweru Gatonye engaged in a heated debate as they differed on a section of law which was omitted when presenting the petition.

The two lawyers disagreed on the inclusion of the deputy governor from the election petition.

Governor Mutua faulted the former Kathiani Member of Parliament (MP) for excluding Machakos deputy governor Francis Maliti in the case.

Nonetheless, lawyer Amollo, who is also Rarieda lawmaker, stated that it was not necessary to include the deputy governor. 

The High Court Judge, however, noted that he would clarify on the matter during the next hearing.

Ms Ndeti was represented by Amollo, lawyers Daniel Maanzo and Apollo Mboya.

On the other hand, Kioko Kilumi, Mohammed Nyaoga, BM Mung'ata and Wilfred Nyamu appeared in court on behalf of Governor Mutua. 

In the election petition, Ms Ndeti noted that the gubernatorial election was marred by irregularities and that IEBC illegally declared Governor Mutua the winner.
