Mathira Member of Parliament (MP) Rigathi Gachagua on Tuesday suffered his first loss in an election petition challenging his win.
Nyeri High Court judge dismissed an application by the Jubilee MP seeking to strike out the case filed by a voter challenging his victory.
In his application, the MP claimed that the petition was altered and should, therefore, be kicked out by the Court.
Nonetheless, the Judge divulged that the election petition would continue as scheduled.

A voter, Michael Gichuru had filed a petition at the court challenging the election of the Mathira MP.
In his petition, Mr Gichuru noted that the court should compel the IEBC to organize a fresh election.
According to the petitioner, the August 8 election was marred by irregularities including the use of fake ballot papers.
He further pointed out that the electoral officers did not stamp forms 35A from most of the polling stations in the region.
Meanwhile, Taita Taveta MP Naomi Shaban has made an application seeking dismissal of a case petitioning her victory in the August poll.

Through her lawyer Noah Nyakundi, she argued that the petitioner did not sign copies of the petition served to the respondents.
