Moses Kuria's Child Forces Court to Postpone Case

A Nairobi court on Tuesday postponed an incitement case against Gatundu South Member of Parliament (MP) Moses Kuria to February 14, 2017.

Milimani Law Courts Senior Principal Magistrate Kennedy Cheruiyot gave the directive to allow Mr Kuria to attend to his child who needs medical attention.

Mr Kuria was granted the request after he sought for adjournment through his lawyer, who argued that he had a sick child who needed to be taken to the hospital.

The prosecution team, led by Senior State Counsel Duncan Ondimu, did not oppose the court order but instead affirmed that they had enough witnesses to testify in the court case.

The Jubilee lawmaker was charged with making statements that were 'desirable to cause death and physical injury to specific individuals in the country'.

Kuria, however, denied ever uttering such sentiments while addressing a crowd in Gatundu Stadium on June 26, 2015.

The legislator was also charged with inciting a group of youth to attack politicians opposed to National Youth Service (NYS) projects.

Despite his earlier release on a Sh2 Million cash bail, the prosecution argued that Mr Kuria continued with the same conduct that formed the basis of the current case.

In his defense, Kuria, through his lawyer, claimed that the incitement case was politically driven.

The court granted the defendant a Sh1 Million bond and warned him against making similar remarks.
