High Court Told How IEBC Officials Rigged Elections

A returning officer admitted at the High Court in Mombasa that polling clerks posed as Jubilee and ODM agents during the August 8 presidential election.

The officials are alleged to have signed a result form at a polling station in Changamwe constituency which was recorded in the voting day diary.

Aisha Abubakar alleged that two clerks signed Form 35A which were used to record results of the National Assembly election as Jubilee Party agents.

She further revealed that another clerk signed a Form 35A as an Orange Democratic Movement (ODM) agent at Chaani Primary Primary School.

Aisha Abubakar, who was testifying before Lady Justice Njoki Mwangi revealed election offences that some Independent Electoral and Boundaries Commission (IEBC) committed.

Lawyer Gikandi Ngibuini, who was representing Mahmoud Mohamed Ali in a petition against the election of Changamwe MP Omar Mwinyi, questioned why the results of the polling station formed part of the final tallying, she stated that it was a mistake.

Mrs. Abubakar in reply to Mr Gikandi’s question on the validity of such results ascertained that “It should not have been tallied”.

She admitted that there were two cases of voters being issued with more than one ballot papers at Mikandini Primary School polling station and Bokole Primary School polling station.

Mrs Abubakar further affirmed that prompt action was taken against the clerks and the voters but admitted that she could not rule out the possibility that other cases were arrested earlier.

Aisha Abubakar, in conclusion, testified that one case was not immediately brought to her attention until the final tallying a the constituency tallying centre.
