Supreme Court Rejects Report on IEBC Documents

The Supreme Court on Thursday declined to admit the report on scrutiny of Independent Electoral and Boundaries Commission (IEBC) result forms by the petitioners.

However, Chief Justice David Maraga directed the petitioners to make observations on the results forms as they responded to IEBC and President Uhuru Kenyatta's arguments.

"You never requested to table the report and so we granted prayers the way you sort," Justice Maraga responded to Lawyer Harun Ndubi's request.

He stated that a report would be new evidence and would not give the respondents enough time to prepare arguments to it.

On Wednesday, the Supreme Court ordered the electoral body to provide the original Forms 34A, 34B, and 34C to the petitioners in the ongoing Presidential Petition case.

Furthermore, CJ Maraga ordered the electoral agency to issue a certified copy of the voter register for scrutiny at the petitioner’s cost.

Following the request, IEBC demanded Sh80 Million to facilitate the printing of the voter register.

Mr Ndubi told the court that they had been asked to deposit the amount in the commission’s accounts in order to get copies of the register.

IEBC, through lawyer Fredrick Sisule explained that the register runs to 450,000 pages adding that if the printing exercise is to be made faster then the cost will be higher.

CJ Maraga and his team dismissed the application by the petitioners seeking to have the memory cards availed, terming the move as 'a fishing expedition'.

Lawyer Julie Soweto had requested the court to order for an analysis of election materials, polling station diaries and GPS coordinates for all KIEMS kits.

She had further requested that IEBC Chair Wafula Chebukati be obliged to present memos exchanged by commissioners between September 20 and October 30.
