Senator Mutula Kilonzo's Angry Reaction to Ban on People’s Assembly

Makueni Senator Mutula Kilonzo Jr reacted to an earlier ruling by High Court Judge Lilian Mutende which barred the adoption of the People’s Assembly motion.

Senator Mutula in a post on his Twitter account poured out his disappointment stating that the injunction was weird, preemptive and unenforceable.

During an exclusive interview with Kenyans.co.ke, Senator Mutula reckoned that the High Court judge had acted in anticipation of an outcome that had not happened.

“You can not challenge an outcome that is yet to happen and that is what happened here, you only challenge the output of the process,” Senator Mutula stated.

Speaking on why he found the injunction weird, the Senator stated that since the Senate operates through the Speaker and the Clerks, "it did not make sense because none of the members were sued".

Moreover, Mr Mutula stated that the decree was out of order since Members of Parliament were injuncted.

He further took issue with the period of time that the injunction was issued which is two months contrary to what the Constitution stipulates.

“If you take a look at the order, it is issued for a period of two months contrary to the period that such an injunction can stand,” Senator Mutula stated.

Senator Mutula laughed off the directive and stated that the different parties involved will not be held accountable for contempt of court since it was impossible to “injunct something you can not injunct.”

Justice Mutende on Monday blocked the Senate, the National Assembly and ward representatives from implementing motions before them for the appointment or election of members, delegations and observers to the People’s Assemblies.
