New Twist In Case Against Kalonzo's Foundation

The Fazul Mohammed-led NGOs Co-ordination Board has accused the Kalonzo Musyoka Foundation of failing to consistently report its financial activities.

While responding to a suit filed by the foundation, Mr Nicholas Lindon, the board's legal manager, stated that compliance officers reviewed the NGO's file and noted various anomalies that had been brought to their attention in a March 1 letter.

He stated: “There were several inconsistencies that were raised, prompting us to again write to the foundation and a suspension issued on the operations to ensure the preservation of status quo to enable investigations.

“I wish to state that the nature of inconsistencies cannot be wished away and the copies of the said letter were sent to all the relevant parties to ensure the required support was given,” he continued.

The board issued a directive to freeze the foundation's bank accounts on May 2, 2017.

The foundation described the move as a witch-hunt by the State and swiftly moved to court to challenge the ruling.

The NGOs Co-ordination board claimed that they had notified the foundation in due time and ordered them to release certain information, including disclosing its bank accounts.

According to Mr Lindon, the documents provided were unsatisfactory and contained unverifiable information.

Among the issues raised was that the foundation has had the same auditor since its inception 10 years ago.

Also, it is alleged that in some instances, donations were declared but donors' names were left out.

Justice Roselyne Aburi will rule on the case on January 24, 2018.
