Court Orders Recount of Marakwet East Parliamentary Election Votes

Eldoret High Court ordered a recount of votes of four polling stations in Marakwet East constituency during the hearing of a petition filed a voter Sammy Kipkeu challenging the election of MP David Kangongo Bowen.

Judge Kanyi Kimondo ordered the IEBC to scrutinize and recount votes from Polling stations in Cheptany, Mungwa, Kumbulul primary schools and Mungwa dispensary.

This comes after Mr Kipkeu applied for the scrutiny and recount on grounds that the August 8 general election was marred by massive irregularities and illegalities.

He wanted the court to order a study of all the 142 polling stations but was granted orders for only four polling stations.

"I am not satisfied that there should be a scrutiny in all the polling stations," the High Court Judge stated in his ruling on Friday.

The court further ordered the scrutiny of all forms 35A against forms 35B for some 14 polling stations in the constituency.

Kipkeu argued that the forms used to declare Bowen as MP on August 9 contained alterations, errors, and discrepancies.

IEBC also admitted that a ballot box from Mungwa hall dispensary polling station was not sealed but maintained that the contents were not removed or accessed.

The court also heard of violence which erupted minutes to the declaration of Bowen as MP leading to the death of a 15-year-old girl.

Bowen was declared the winner of the parliamentary election by returning officer Martin Wekesa, who is the third respondent, he defeated former MP Linah Kilimo with 967 votes.
