IEBC Officials in Babu Owino's Election to Face Charges - Court Rules

The Embakasi East parliamentary case between Babu Owino and Francis Mureithi has taken a new twist after the court ruled that two Independent Electoral and Boundaries Commission (IEBC) officials involved had a case to answer.

Mureithi, who vied under the Jubilee Party ticket, went to court challenging Babu Owino's victory in the August 8 General Elections.

In his petition, Mr. Mureithi argued that there were massive errors in the vote tallying process hence the need for the court to intervene.

As a result, Justice Joseph Sergon ordered for a votes scrutiny and recount process that was concluded on Monday.

However, there were allegations by Mureithi that the case was inconclusive as ballot boxes from six polling stations were missing during the tallying in a constituency that has a total of 207 polling stations.

Mureithi further claimed that Forms 35A for over 60 stations were missing during the exercise.

According to Mureithi, other forms had no IEBC stamps and Officials' Signatures indicating a failure to comply with the voting and tallying process according to the set election rules that require results to be accurate and verifiable.

If true, these allegations may have informed the latest court ruling proposing filing of charges against the two IEBC officials.

IEBC results released in August indicated that Babu Owino had trounced his main competitor garnering 46,587 votes against Mureithi's 42,253.

The outspoken Owino has in the past blamed his election petition woes on the Jubilee government of which he is a great critic.
